27 Feb 10 I Won against Discover Card!!!!!

First a huge THANK YOU to Frank and this site for showing me I could fight this! I went toe to toe with Discover’s lawyer for almost 2 hours. I held my ground and stayed focused on my talking points. It was real hard now and then when the lawyer attacked my credibility and the “authenticity” of my evidence. The judge had to warn me a number of times about my remarks and to answer the question.
Discover’s attorney tried real hard to keep the printed info from the web out, he said it wasn’t “verifiable” but the judge allowed it because he said the web was “public domain” (the info I used was a google search showing all the “fraud” hits for Gisol, the Youtube links for the Fox news videos, stories of others that were similar to mine, the class action suit and the LA county sheriffs info) I used my phone records to show that the time stamp on the bogus signatures did not match the time I was on the phone with Gisol (it was off by hours and all after my phone call had ended) Plus I pointed out that each signature was different and each had a different customer ID. I also referred to the “use” agreement and pointed out that I never uploaded 1 byte of info to the site so per their own contract there was no agreement and the policy was void. I also pointed out that this was all information that I had previously provided Discover with for their investigation.
Since I was suing on the grounds that Discover failed to do a proper investigation Discover’s attorney focused on my complaint letter to them and where I said in them that Discover’s investigations kept finding in Gisol’s favor. He said that was proof from me that they had conducted investigations. I rebutted by saying that all I had was their word they did an investigation as all I received from them was a letter telling me their finding but never saw, nor did he bring proof of what Discover’s investigation consisted of. Since they were attacking the “veracity” of my word I was going to do the same to them. I closed by saying that any reasonable person who did half the research I did would come to the easy conclusion that Gisol was engaging in Fraud and criminal behavior.
When the judge delivered his verdict one of his points was that Discover did fail to show evidence they investigated and also said that even as he looked at the contract several things clearly popped out as suspect/red flags that Discover could have/should have picked up on.

23 Feb 10 Going to court against Gisol and Discover

I will be getting my day in court Tuesday 2-23-10 in the Johnson County sub court house in Burleson TX, 76028. Any fellow disgruntled who can show up with their stories or even just for support would be a help
